Revised Bond Rate Guidelines to take effect July 1, 2005

Revised Bond Rate Guidelines for the Calculation of land Reclamation Bonds on Coal Mining Operations will take effect on July 1, 2005. The major change is for Stage 3 reclamation sites. The maintenance bond is changed from $500 to $100 per acre on most anthracite operations. Please see the notice posted in the Pennsylvania Bulletin at this link

Coal Conventional Bonding Guidance and New Annual Bond Review forms

A new Technical Guidance Document has been finalized on March 12, 2005 for Conventional Bonding for Land Reclamation - Coal. This is an update of the previous version issued at the original conversion to full-cost bonding and remains document number 563-2504-001. Please review the new version because significant changes and clarifications are included. It can be viewed online in the eLibrary at this link

Also, the forms for Annual Bond Review have been updated. It is requested that you review the new instructions and forms for submitting your yearly reviews. These forms can be obtained at the Pottsville Office. Old forms will still be accepted but if you do not have the required information, the submission may be returned to you. Please contact the Permits and Technical Section in Pottsville with questions.

New Anthracite Surface Mine Permit Applications In Effect

Revised application and Modules for surface mines, bank reprocessing and prep plants and all surface mining activities are now available for your use for all new permits and revisions to existing permits. Previous editions of the application modules will be accepted only until April 1, 2005. After that date, only the new version will be accepted for ALL coal surface permit applications. Please contact Sharon Hill, Permits Section at the Pottsville office if you have any questions. The application modules are available on DEP’s eLibrary.

Signatures needed

Pottsville DMO reminds you that ALL revisions to your permit require an authorized signature from the permittee. Please submit page 1-1 of the application and the affidavit page, signed and notarized by a company official.




Attn: Coal permittees utilizing coal ash for reclamation
Module 25 Reporting

Please submit your quarterly and annual groundwater reporting and ash analysis on Module 25 forms. Also attach the lab results. Report non-detectable results as less than the given detection limit, not N.D. or 0. The forms are found in Module 25 in the Anthracite SMP application on DEP's eLibrary.
