TITLE: POLICY FOR DEVELOPMENT, APPROVAL AND DISTRIBUTION OF GUIDANCE AND POLICIES

POLICY:
The Department of Environmental Protection (DEP) will follow a department-wide, standard process for developing, approving and distributing technical guidance documents.
PURPOSE:
The purpose of this document is: 1) To establish standards for the content of technical guidance documents and create a uniform process for developing, approving and distributing these documents and 2) To comply with the Governor’s Executive Order 1996-1 regarding Regulatory Review and Promulgation as it relates to non-regulatory documents.
APPLICABILITY:
This policy applies to DEP’s non-regulatory public documents that the Commonwealth of Pennsylvania catalogs once a year in the Pennsylvania Bulletin.
This guidance applies to: development of new guidance, substantive and minor revision of existing guidance, the addition and removal of existing guidance to and from the Inventory, and rescission of existing guidance.
This policy does not apply to administrative operating procedures, such as personnel rules, procurement processes, and the administrative handling of contracting. This policy specifically addresses the development, approval, and dissemination of program guidance.

DEFINITIONS
"Decisions" 1) (used as a category on the Governor’s List of non-regulatory documents) are memoranda of understanding (MOUs) and other interagency agreements, agreements made between DEP bureaus, delegations of authority and policies which establish the direction DEP intends to follow. 2) (used to describe how DEP develops guidance documents and, specifically, used to compare ordinary decisions to policy decisions) are the choices which DEP staff make to deal with a site-specific, one-time-only situation. Before such decisions can become policy, DEP: 1) decides to use them as a guide for DEP’s future decision-making in similar situations and 2) formalizes the decision through the development, approval and distribution process outlined in this document.
"External Guidelines" (used as a category on the Governor’s List of non-regulatory documents and added to that list as "other written materials") are DEP’s guidance which are primarily directed to the regulated community or members of the public who DEP does not regulate, but who DEP does wish to educate and assist. Examples of such guidance are those directed toward municipal sewer authorities or instructions to laboratories outside of DEP. On the Governor’s List, DEP’s public manuals are listed under the external guidelines category.
"Guidance Document" is a document that provides: 1) an interpretation of a statute or regulation for statewide use, 2) guidelines or instructions to staff or the public on how to comply with the statute or regulation, or 3) a statement of policy direction or procedure concerning the implementation or interpretation of a statute or regulation.
"Guidance Manual" is a comprehensive collection of all internal guidelines relevant to the subject covered. The subject tends to be how an entire program is run; the manual tends to be large. Within this category "Staff Handbook" is a guidance manual intended for DEP staff and "Public Manual" is a guidance manual intended for members of the public.
"Internal Guidelines" (used as a category on the Governor’s List of non-regulatory documents) are DEP’s guidance directed to DEP staff. In comparison to guidance manuals, internal guidelines tend to be brief and tend to deal with one specific aspect of a program. [Note: The "procedures" portion of "policy and procedures" are "internal guidelines," too.]
"Listings" (used as a category on the Governor’s List of non-regulatory documents and added to that list as "other written materials") are official rosters, registers, catalogs or itemized lists. One example of a listing is the DEP Technical Guidance Document Inventory; another is the DEP Publication Guide.
"Minor Revision" is a change to DEP’s guidance that:

"New Guidance" is DEP guidance that has not previously existed in any form.
"Non-regulatory Documents" (as defined in the Governor’s Executive Order 1996-1) are internal guidelines, policy statements, guidance manuals, decisions, rules and other written materials that provide directives, guidance or other relevant compliance related information to the public.
"Policy" 1) (to contrast policy to a statute, a regulation or an adjudication) is a formalized decision which DEP makes which establishes the framework, within which DEP will exercise its administrative discretion in the future. 2) (used as one of the standard elements which appear at the beginning of each DEP guidance document) is a statement of the decision which DEP is making in the specific guidance document. This statement should be brief and, at the most, two sentences.
"Policy and Procedures" (used as a category on the Governor’s List of non-regulatory documents and added to that list as "decisions") are DEP guidance documents which combine a DEP decision with the series of steps DEP directs its staff to take to implement the decision.
"Statements of Policy" (used as a category on the Governor’s List of non-regulatory documents) are any policies which DEP publishes in the Pennsylvania Code. In general, these are policy decisions which DEP considers to be broad in scope and long-lasting in duration and wishes to distribute widely. The Policy Statement is the entire document.
"Reference Materials" are materials that are not technical guidance but which DEP programs use and to which DEP staff refer. Examples of such materials include:

"Substantive Revision" is any other category of change made to guidance that is neither development of new guidance nor a minor revision.
"Technical Guidance Document" is a document that provides practical and specialized direction to DEP program staff. It often deals with a subject that requires scientific training and understanding. In the context of this document, DEP uses this term to contrast these documents to other DEP guidance; such as personnel, procurement or administrative guidance documents.
I. FORMAT OF GUIDANCE DOCUMENTS

2. All guidance documents will include the following disclaimer on the elements page of every guidance document:

C. FORMATTING
1. Times New Roman 12-point font is recommended when appropriate.
2. Utilize MS Word 6.0 (Word for Windows) where possible. When utilizing other software (ex: MS WORD 7.0 (Windows ‘95)) save as a Word 6.0 document.
3. Identifying Footer: Each page is to have a footer with the following information, in the following order:
document number / effective date of guidance (spell out the month) / page number of guidance
4. Effective Dates will be set no sooner than the date of the document’s final announcement in the Pennsylvania Bulletin.
5. Integrity of Location Numbers: Each document will have a unique volume and tab location in the files.
6. Appendices may include copies of department forms relevant to state or federal regulations, etc.
II. CONTENT OF GUIDANCE DOCUMENTS
DEP will develop its technical guidance documents using these guidelines regarding content.
A. CONFORMANCE WITH STATE STATUTES AND REGULATIONS: Technical guidance should explain but not enlarge or diminish the scope of statutory or regulatory provisions. Positions taken in guidance must be consistent with state statutes and regulations. The program will secure the assistance of the program attorney to ensure this conformity.
B. NO MORE STRINGENT THAN FEDERAL REQUIREMENTS: Technical guidance should be no more stringent than applicable federal requirements.
C. ECONOMIC IMPACTS: Technical guidance should not diminish Pennsylvania’s competitive economic advantage. Where at all possible, DEP should minimize the costs for individuals, businesses, and local governments to obtain agency approvals and meet compliance requirements; DEP should provide flexibility to employ cost effective alternatives. Guidance should help promote the use of market-based economic incentives to encourage desired behavior. In addition, DEP should minimize agency costs associated with staffing, technical reviews, and compliance assistance.
D. COMPLIANCE ASSISTANCE: Technical guidance should clearly identify what DEP needs for compliance with its regulations. The program area is to develop a specific compliance assistance plan highlighting the need and provisions for educational materials and outreach.
Guidance should place emphasis on cooperation, innovation and education as a way to achieve higher levels of compliance. Guidance should give special attention to the unique needs of individuals, small businesses, and local governments as related to educational, technical and other forms of compliance assistance.
E. POLLUTION PREVENTION: Guidance should help promote the use of pollution prevention technologies and procedures.
F. PERFORMANCE OR OUTCOME ORIENTED: To the extent allowed by regulation, guidance should focus on achieving the desired level of environmental performance. Programs should encourage maximum flexibility to achieve the desired outcome rather than prescribing specific technologies or equipment.
G. NECESSITY: Guidance should be up-to-date and needed to help implement current laws and regulations. Guidance should not be redundant with other guidance. Guidance should reduce paperwork, minimize administrative burdens, and save time for both the regulated community and agency staff.
H. CLARITY: Documents should contain plain, simple, clear and concise language. Programs should use non- technical language to the greatest extent possible. Documents should provide clear interpretation of agency requirements while reducing the potential for uncertainty and confusion by agency staff or the regulated community.
I. GREEN TECHNOLOGIES: Guidance should help promote the utilization of new, less-costly methods and technologies that will maintain or improve environmental quality.
III. REVISIONS TO TECHNICAL GUIDANCE DOCUMENTS: All guidance documents will follow a standardized procedure to ensure proper internal review and public comment.
A. DRAFTING OF NEW GUIDANCE AND REVISIONS TO EXISTING GUIDANCE
1. The Draft Stage
a. Preparation of Draft Guidance: A draft of all new guidance and substantive revisions will be prepared to allow internal and external review and comment.
b. Format of the Draft: All technical guidance documents should be placed in the standard format (See Section I) at the draft stage. Include the word "DRAFT" in the footer on all pages.
c. Review of the Draft: Drafting of guidance documents may include input from DEP program staff, regional staff, executive staff, advisory committees, or other interests as appropriate.
d. Preparation of Impact Analysis: Bureau directors will include an impact analysis with any draft technical guidance forwarded for review. The impact analysis will be prepared in accordance with Section V.
e. Preparation of Draft Technical Guidance and the Draft Technical Guidance Transmittal Memo: A draft of all new guidance and substantive revisions will be made available for public comment. The bureau director will prepare a memo announcing the draft technical guidance. The elements of this memo will include:

g. Approval of draft guidance: Draft guidance documents will be forwarded to the deputy secretary and the Director, Bureau of Regulatory Counsel by the bureau director for approval. In addition, a copy should be sent to the Policy Office Technical Guidance Document Coordinator. The signatures of the deputy secretary and regulatory counsel must be obtained on the draft memos prior to general distribution.
h. Distribution of the draft: The bureau director will distribute the draft technical guidance, draft technical guidance transmittal memo and impact analysis, with appropriate deputy secretary and Director, Bureau of Regulatory Counsel signatures, minimally to:
i. Electronic Distribution: Programs must forward an electronic copy of the document to the Policy Office Technical Guidance Document Coordinator for posting to DEP’s World Wide Website. This electronic copy should accompany the paper copy, memo and impact analysis. (See Section VII: Electronic Availability)
j. Receiving comments: The deadline for submittal of comments is the date comments should arrive at the contact person’s office. This date should be no less than 30 days from the publication of the document’s availability in the Pennsylvania Bulletin. Memos received by the Policy Office the end of the day Monday will appear in the Pennsylvania Bulletin on the second Saturday thereafter. The draft technical guidance memo will include a contact person, phone number and e-mail address to which comments can be made.
k. Preparation of Comment and Response: Program staff involved in developing the guidance will review comments received by the comment deadline. Program staff will prepare a formal comment response document. In this document, program staff will give a substantive response to every comment received.
2. The Final Stage
a. Preparation of Final Guidance: All new guidance, substantive revisions and minor revisions will be circulated as final guidance.
b. Format of the Final Guidance: DEP’s Technical Guidance Documents follow a standard format (See Section I.C. Formatting). Also, be sure to remove all references to the word "Draft" in the footer and throughout the document.
c. Review of the Final Guidance: Drafting of guidance documents may include input from DEP program staff, executive staff, advisory committees or other interests as appropriate. In addition, any document that will also serve as a department publication must complete the Department’s publication approval process administered by the Publications Coordinator prior to its distribution.
d. Preparation of Final Technical Guidance Transmittal Memo: All final guidance will be widely distributed throughout DEP to ensure staff possess the most current official policies. The bureau director will prepare a memo announcing the final technical guidance. The elements of this memo will include:

e. Approval of Final Guidance: As with draft guidance, prior to its distribution, completed guidance documents will be forwarded to the deputy secretary and regulatory counsel for final approval, as well as the Policy Office Technical Guidance Document Coordinator, by the bureau director. The signatures of the deputy secretary and the Director, Bureau of Regulatory Counsel must be obtained prior to distribution. In addition, a copy of the "Authorization to Print" memo from the Publications Coordinator must be included with a guidance document that will be a publication.
f. Distribution of Final Guidance: Copies of all finalized technical guidance documents will be distributed to all affected program staff. In addition, many members of the public will receive copies of the document. The final distribution will generally include:
- The Program Deputy,
- Chief Counsel,
- The Deputy Secretary for Field Operations, if the document is used in the field,
- The Policy Office (two copies - not stapled),
- The DEP Technical Library,
- The Chief Counsel’s Library,
- The Lead Regional Director, as appropriate,
- Staff responsible for maintaining complete sets of technical guidance,
- Staff responsible for program binders of technical guidance.
(Appendix D, page 28 D-VI-D-VII gives the specific DEP personnel to whom copies should be distributed.)
g. Distribution of the Comment/Response Document (Not Applicable to Minor Revisions): Copies of the comment/response document should be distributed, along with the final technical guidance, to select DEP staff. This document need not be distributed to the entire program list. The comment/response document needs only be distributed to:
h. Electronic Distribution: An electronic copy of the final document must forwarded to the Policy Office Technical Guidance Document Coordinator for posting to DEP’s World Wide Website. This electronic copy should accompany the paper copy of the final document, the final guidance transmittal memo and comment/response document. (See Section VII: Electronic Availability.) Please note that for large, voluminous guidance, please submit in the "technica" shared file.
3. Minor Revisions
a. Nature of Minor Revisions: Changes to department technical guidance documents that meet the definition of a minor revision need not undergo the full technical guidance process. Only the steps described in Section III (A)(2)b Format of the Final Guidance need be followed. Again, remove the word "Draft" when preparing a final document.
b. Determination of Minor Revision: The program bureau director will determine whether a change meets the definition of a minor revision by consulting this policy and the Policy Office Technical Guidance Document Coordinator.
c. Implementing a Minor Revision: Once the bureau director determines that a revision to a guidance document will qualify as a minor revision, the program may announce the changes immediately as Final Guidance. No Draft Guidance stage is necessary. Refer to the paragraph (A)(2), Final Guidance for policy on distributing Final Guidance. This revision should also be noted on the Standard Elements page under the effective date by adding a sentence "Minor Revisions were made to pages…" followed by the date that you use on the revised pages.
d. Exceptions to Final Guidance Procedures for Minor Revisions: When finalizing Minor Revisions, program staff need not prepare and distribute a Comment/Response document (see paragraph (C)(7) (III) (A) (I) (i.e.). Clarify comment/response documents only for public, not internal (DEP) comments
B. RESCINDING, REMOVING OR ADDING TECHNICAL GUIDANCE DOCUMENTS
1. Type of Changes
a. Notice of Intent to Rescind: If a bureau director determines to rescind a technical guidance document, the bureau director will prepare a Notice of Intent to Rescind.
1. The bureau director and program staff should consult other DEP program and regional staff, advisory committees, or other interested parties as appropriate.
2. The effective date for a Notice of Intent to Rescind can be no less than ten working days after the Notice appears in the Pennsylvania Bulletin. If the Notice of Intent to Rescind does not include a rescission date, the rescission date is ten working days after the date of the memorandum. Upon the arrival of the effective date, all copies of the technical guidance document should be removed from department files.
b. Notice of Intent to Remove: A bureau director may determine that a document currently listed as a technical guidance document should be removed from the Inventory. To remove such a document from the official list of department technical guidance documents and policies, the bureau director must prepare a Notice of Intent to Remove Technical Guidance. This would be completed in the same manner as a Notice of Intent to Rescind.
c. Adding Guidance Documents: A bureau director may determine that a departmental document, fact sheet, publication, etc. currently not regarded as a technical guidance document does, in fact, qualify. To add such a document to the official list of technical guidance documents and policies, the bureau director would prepare a Notice of Intent to Add Technical Guidance. The addition would become effective upon its publication in the Pennsylvania Bulletin.
2. Preparation of the Notice of Intent to [Rescind, Remove or Add] Technical Guidance: If it is determined that a program should rescind, remove or add to its technical guidance, the bureau director prepares a Notice of Intent.
a. Elements on the Notice of Intent: The Notice of Intent memo indicates:

C. THE ROLES OF THE EXECUTIVE STAFF, THE BUREAU OF REGULATORY COUNSEL, THE POLICY OFFICE AND THE WORLD WIDE WEB COORDINATOR IN THE DEVELOPMENT OF TECHNICAL GUIDANCE
1. Executive Staff Review: The executive staff may decide to review and comment on a guidance document at any point throughout the process. Any executive staff member involved in guidance development should notify the bureau director responsible for the guidance and the Policy Office of their intent.
2. The Role of the Bureau of Regulatory Counsel: The Bureau of Regulatory Counsel will review all guidance documents prior to their distribution for comment. The Bureau must approve all changes to DEP technical guidance documents, except for minor revisions.
3. The Role of the Policy Office:
a. Through the process, the Policy Office Technical Guidance Document Coordinator receives:

D. GUIDANCE DOCUMENTS / PUBLICATIONS
1. Implications of being a document / publication
a. The document will be considered primarily technical guidance. It will:
1. Obtain a DEP ID number and follow the format for technical guidance.
2. Go through the entire technical guidance drafting and revision process.
3. Be listed on the Inventory of Technical Guidance Documents.
2. Process for Publishing a Guidance Document
a. Prior to its transmittal throughout the department, any guidance document that will become a publication must be Office of Policy and Communication’s publication approval process. (See OPC’s Demystifying the Publications Process.) The Publication Coordinator will review the text to insure documents for publication meet the criteria of that office and the Governor’s Office.
b. A copy of the publication’s Authorization to Print, as dictated by the publication approval process, will be included with a technical document receiving final review by the deputy secretary, director and the Bureau of Regulatory Counsel.
c. The document will be available through the Publications and Communications Warehouse. In addition:
1. The document will not receive a publication number. It will maintain its technical guidance ID.
2. For its internal tracking purposes, the Warehouse will place the ICS code for the relevant bureau and the letters TG for Technical Guidance in front of the DEP ID number for the document.
3. The program may choose to (but is not required to) obtain assistance from the graphics unit and the Communications Office to help them make the document attractive and readable.
IV. DISTRIBUTION OF TECHNICAL GUIDANCE TO THE PUBLIC
A. ELECTRONIC DISTRIBUTION
1. Official Electronic Copies: The Policy Office Technical Guidance Document Coordinator will maintain an official electronic copy on disk of every document posted to the web. For voluminous documents, please submit via shared files to the "Technica" file.
2. Electronic Distribution: Technical Guidance Documents will be maintained for distribution on DEP’s World Wide Website. This will be the primary means of distributing documents to the public and will be encouraged.
B. PAPER COPY DISTRIBUTION
1. Official Copy of Final Guidance Documents: The copy the technical guidance document located in the Policy Office files will be considered the official copy. Each program should ensure that this procedure is fully implemented to insure the Policy Office document reflects current departmental policy. A revision to a guidance document will become official and placed in the Policy Office files when the announcement of that change appears in the Pennsylvania Bulletin.
2. Filling Public Requests for Technical Guidance Documents: The Policy Office will provide copies of technical guidance documents to the public. Additionally, the program may wish to distribute copies of its guidance to the public. However, only documents which mirror the Policy Office file copy should be distributed to the public as final guidance. The program should not distribute any document to the public which is in anyway different from the official Policy Office file copy as final technical guidance. Furthermore, paper copies of guidance should only be distributed if good reason for not utilizing the world wide website exists.
V. IMPACT ANALYSIS
Bureau directors will attach an impact analysis to their memos transmitting draft technical guidance for review. The impact analysis will address each of the following considerations as necessary.
A. GUIDANCE IMPLEMENTS LAWS OR REGULATIONS MORE STRINGENT THAN FEDERAL REQUIREMENTS: Any technical guidance implementing state laws or regulations more stringent than federal requirements should note same with appropriate citation.
B. PRESCRIPTIVE OR TECHNOLOGY SPECIFIC GUIDANCE: If the guidance is prescriptive or technology specific rather than providing flexibility to achieve a desired level of environmental performance, the program must justify this approach and identify the parent statutory or regulatory citation.
C. AFFECTED REGULATED COMMUNITY: Describes the types of businesses, local government units, or industries potentially affected by the guidance. Estimate the number of facilities or sites potentially affected.
D. ECONOMIC IMPACT-REGULATED COMMUNITY: Estimates the potential costs or savings which may result from the guidance on industry, local government, and individuals, including the potential impact on property values.
E. ECONOMIC IMPACT - DEP: Estimates the potential costs or savings of the guidance on the agency. If the program requires additional positions, the program should identify these positions for both field and central offices.
F. COMPLIANCE ASSISTANCE: Describes how the guidance will affect the level of compliance within the program. Describes how the guidance will minimize or reduce pollution.
G. POLLUTION PREVENTION: Describes how the guidance will enhance pollution prevention efforts.
H. DEP REVIEWS AND APPROVALS: Describes how the guidance affects the time necessary to process DEP reviews and approvals.
I. RELATIONSHIP TO EXISTING GUIDANCE: Describes how this guidance may affect other guidance within the program or the agency. Describes whether or not existing agency guidance will be rescinded or changed.
J. CONTROVERSIAL ASPECTS OF GUIDANCE: Identifies any aspect of the guidance which is likely to be controversial, explains why it’s controversial, and describes what actions were taken to minimize the problem.
VI. LISTING DOCUMENTS: THE GOVERNOR’S LIST, THE INVENTORY, THE PUBLICATION GUIDE AND LISTS OF IMPLEMENTATION PROCEDURES AND REFERENCE MATERIALS
A. THE GOVERNOR’S LIST: Governor Tom Ridge signed Executive Order 1996-1: Regulatory Review and Promulgation on February 6, 1996. It states the following about Non-regulatory Documents (Section 5):
B. IMPLEMENTATION: DEP divides its list into the following categories: Policy Statements, Decisions, Guidance Manuals, Policy and Procedures, Internal Guidance, External Guidance and Listings. (Please also refer to the section of definitions.)
C. THE INVENTORY: DEP lists its Technical Guidance in the Technical Guidance Document Inventory, which DEP publishes twice a year in July and January. DEP places a copy of its most recent Inventory on the DEP World Wide Website.
VII. ELECTRONIC ACCESSIBILITY
A. DEP will maintain a complete library of its technical guidance on its World Wide Website. The Policy Office will maintain this Website.
B. Electronic copies of technical guidance documents will be delivered to the Policy Office in the following format:

Document Numbers are a composite of three types of information. The first three digits, in general, correspond to the ICS organizational code for the originating program area. [For some programs, the organizational code has been expanded to contain other useful organizational information. Please refer to the codes listed below.] The second four digits correspond to the type of document in question. The last three digits are for the use of the program areas. The three digits can be used in any way that the program area sees fit, so long as the full ten-digit Document Number is unique.
