  4. This guidance is not prescriptive or technology specific. This guidance allows for flexibility while providing consistency for the suspension or revocation of blasterís licenses.

  6. All Pennsylvania licensed blasters.

  7. ECONOMIC IMPACT-REGULATED COMMUNITY:

  8. This guidance will facilitate consistent handling of serious blasting violations, including the suspension or revocation of blasterís licenses. There will be no economic impact unless a blasterís license is suspended or revoked, changing the blasterís employment status

  9. ECONOMIC IMPACT-DEP:

  10. The economic impact of this guidance on DEP is insignificant.

  11. COMPLIANCE ASSISTANCE:

  12. The Blasting and Explosives Inspectors and other DEP personnel will assist industry when applying this guidance.

  14. This guidance will not minimize or reduce pollution.

  15. DEP REVIEWS AND APPROVALS:

  16. This guidance will provide uniform guidelines for investigating of serious or deliberate violation incidents and determining whether to revoke or suspend blastersí licenses.

  18. This guidance is a revision to 562-2402-501, Suspension and Revocation of Blasterís Licenses.

  19. CONTROVERSIAL ASPECTS OF GUIDANCE:

  20. This guidance is not controversial. Both the majority of industry representatives and the public feel serious violations require appropriate regulatory responses. The Department has a history of suspending blasterís licenses for serious violations.
