Dear Committee Members:

During my visit with some of you to the Bark Camp Reclamation Lab site on July 3, I discussed a concern the Department had raised with the ownership of Consolidated Technologies, Inc. (CTI). That is, CTI is owned by Clean Earth, Inc. which is a wholly owned subsidiary of U.S. Plastic Lumber (USPL). Two shareholders of USPL had signed an agreement with DEP in 1992 that limited their waste related activities in Pennsylvania. Since the current reclamation by CTI is being accomplished under a beneficial use order by DEP’s waste program, the two USPL investors were in potential violation of the 1992 agreement.

On August 13, 1998, the two USPL shareholders of concern signed an addendum to the 1992 agreement. This addendum fully addresses and satisfies the points previously identified by the Department. We will continue close monitoring of this to ensure the provisions of the original agreement and the addendum are followed. A copy of the August 13 addendum is enclosed for your information.
